The right to vacation is one of the most important guarantees for Brazilian workers. Every employee with a signed work card is entitled to 30 days of paid leave after each 12-month work period.

Understanding how to calculate vacation pay is essential to verify if the payment is correct. The calculation involves base salary, the constitutional bonus, and possible proportions based on time worked.

Vacation Rights in Brazil

Acquisition and Granting Periods

The acquisition period is the 12 months the worker needs to be employed to earn vacation rights. The granting period is the following 12 months when the employer must grant the vacation.

The company has up to 12 months after the acquisition period to grant vacation. If this deadline isn’t met, they must pay double vacation pay as a penalty.

How to Calculate Vacation Value

Basic Vacation Calculation

Vacation value is calculated on the previous month’s salary before vacation, including fixed allowances like hazard pay, danger pay, and regular commissions.

The basic formula is: Salary + 1/3 constitutional bonus

Example: R$ 2,500.00 salary → Vacation = R$ 2,500 + R$ 833.33 (1/3) = R$ 3,333.33

Constitutional Bonus (1/3)

The constitutional bonus is an additional 1/3 on vacation value, guaranteed by the Federal Constitution. This amount is mandatory and cannot be waived by the worker.

To calculate: divide salary by 3. If salary is R$ 3,000, the bonus will be R$ 1,000.

Proportional Vacation

When a worker hasn’t completed 12 months at the company, they’re entitled to proportional vacation. The calculation considers how many complete months they worked.

The formula is: (Salary ÷ 12) × months worked + 1/3

Example: 8 months worked, R$ 2,400 salary → (R$ 2,400 ÷ 12) × 8 = R$ 1,600 + R$ 533.33 (1/3) = R$ 2,133.33

Vacation Cash Conversion

Selling 10 Days of Vacation

Workers can sell up to 10 days of their vacation to the company, receiving the corresponding value. This is the employee’s choice, not an obligation.

To sell days, written notice must be given up to 15 days before the end of the acquisition period.

Cash Conversion Calculation

The conversion is calculated on 10 vacation days + proportional 1/3. The amount received doesn’t replace rest - the worker takes 20 days off and receives payment for 30.

Example: R$ 3,000 salary → 10 days = R$ 1,000 + R$ 333.33 (1/3) = R$ 1,333.33 conversion

Collective and Divided Vacation

Collective Vacation

Companies can grant collective vacation to all employees simultaneously. It can be up to 30 days or divided into two periods of at least 10 days each.

Collective vacation must be reported to competent authorities 15 days in advance.

Individual Division

Vacation can be divided into up to 3 periods:

  • One minimum period of 14 consecutive days
  • Others of at least 5 consecutive days each
  • Cannot start on the 2 days before holidays

Absence Deductions from Vacation

Unjustified absences reduce vacation period according to legal tables. Justified absences (medical certificate, marriage, child birth) don’t affect the right.
